Writ of Possession & Reservation: The newest edition of the Writ of Possession form (updated 10/07) contains a checkbox for the plaintiff to indicate that no rent has been accepted without a letter of reservation. If this form is used and the box is checked, then the General District Court will no longer require a letter stating no rent has been accepted without reservation when filing the Writ of Possession. If the older form without the checkbox is used, the letter or reservation should be attached.

Social Security Number on Garnishment: Many government agencies and financial institutions are now requiring the judgment debtor’s social security number before they will respond as the garnishee on a Garnishment Summons. The General District Court recommends the social security number be furnished on all future Garnishment filings.

Small Claims Removals: Removals from Small Claims Court to GDC Civil will no longer be pulled and processed prior to the Small Claims court date. Instead, the Removal will be attached to the file and the case will go into court on its scheduled Friday. This will allow the parties to select their trial date in GDC Civil and the judge to order pleadings, as requested.
- DWI Continuances: Effective September 7, 2010, all DWI continuance requests in the General District Court will require the prosecutor’s signature as either agreed or objected to. Once signed, these should be dropped off in the Traffic Clerk’s Office, Room 106, by 3pm at least two days prior to the court date. If objected to, the clerk will forward the continuance request to Chambers for a judge’s review the next morning. Attorneys may call the Traffic Continuance Call-back Line (703-246-2336) after 10am for the decision.
- New Circuit Court Policy Change: The judges of the Circuit Court have decided to adopt a system for the appointment of guardians ad litem for infants in cases seeking the approval of an infant settlement and for minor beneficiaries in a case seeking approval of a wrongful death settlement which is similar to that in use in Loudoun County. - General District Court Note on Civil Garnishments: When filing a garnishment summons in the Civil Division of the General District Court, the judgment debtor’s complete nine digit social security number is required if the U.S. Postal Service or some federal agencies are named as garnishee. A number of garnishments have been rejected by the Postal Service lately stating they are “insufficient as to legal form” because they contained only the last four digits of the debtor’s social security number.

- New Memo: Waivers for Statutory Fee Caps for Court Appointed Counsel are eligible for submission again as of July 1, 2010. A useful list of links to the Virginia Supreme Court policy memos can be found here.
- Update: The Supreme Court of Virginia has entered a rule amending Part Five of the Rules of the Supreme Court of Virginia to be effective July 1. These amendments make significant changes to appellate procedures in both the Supreme Court and Court of Appeals in Virginia. Go here to view the amendments and changes.
- From the VA Supreme Court: Update from the Appellate Rules Advisory Committee Report
- Gov. Timothy M. Kaine appointed Court of Appeals Judge LeRoy F. Millette Jr. to the Supreme Court of Virginia and replaced him with Chesterfield Circuit Judge Cleo E. Powell on the intermediate appellate court. Kaine also named McGuireWoods LLP partner James C. Dimitri to the State Corporation Commission. And he appointed two Circuit judges in Fairfax County, Jan Lois Brodie, deputy county attorney in Fairfax, and David S. Schell, a Juvenile and Domestic Relations district judge, in Fairfax, and Charles S. Sharp, the commonwealth's attorney in Fredericksburg, to a post in the 15th Judicial Circuit.
- Effective February 1, 2008, the Supreme Court of Virginia entered amendments to the Rules of Court. For a complete listing of the changes, please click here.
- Effective February 1, 2008, the Supreme Court briefs and other papers must be filed in one of three fonts: Courier, Arial or Verdana, and the typeface must be 14-point or larger, up from the 12 points now allowed. The page limiters remain the same, which means you can get only five-sixths as many words in briefs that you think require as many pages as allowed. Read the full story on the

Williams School of Law with a Juris Doctor degree. Mark will be working in the areas of real estate, landlord/tenant and wills and estates.
- Peter J. Wiernicki has been elected Vice-President for the American Academy of Adoption Attorneys. The Academy is a national organization of over 300 attorneys who have distinguished themselves in the field of adoption law.
